We provide this website, including all information, tools, sartorial merchandise, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated herein.

In accordance with the Electronic Commerce (EC Directive) Regulations 2002, our trading details, electronic contact channels, and geographical base are clearly stated above. By visiting our boutique and/or purchasing an item from us, you engage in our service and agree to be bound by these Terms of Service.

2. Eligibility & Consumer Status

By agreeing to these Terms of Service, you represent that:

  • You are at least 18 years of age or possess the legal capacity to enter into binding contracts under the laws of England and Wales.

  • You are purchasing items primarily as a consumer for personal, domestic, and private use.

3. Contract Formation (Online Orders)

Pursuant to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

  • Order Invitation: The display of garments, accessories, and prices on our website constitutes an invitation to treat, not a legally binding offer.

  • Order Placement: When you place an order, you will receive an automated email acknowledging receipt of your order. This acknowledgement does not constitute acceptance of your order.

  • Contract Acceptance: A legally binding contract between you and Frauntch Schull is only formed when we formally dispatch the items to you and send a dedicated Dispatch Confirmation email containing tracking information.

  • Right to Refuse: We reserve the right to decline or cancel any order prior to dispatch due to unverified payment details, stock unavailability, or obvious pricing errors.

4. Pricing, Accuracy & VAT

  • All prices displayed on frauntchschull.store are quoted in Pounds Sterling (GBP / £) and are inclusive of applicable UK Value Added Tax (VAT) at the prevailing rate.

  • Delivery charges are clearly itemised and added during the checkout process prior to final payment authorisation.

  • While we endeavour to ensure that all details, descriptions, and prices are accurate, technical errors may occasionally occur. If an item has been incorrectly priced, we will contact you immediately and offer the choice of reconfirming your order at the correct price or cancelling it with a full refund.

5. Passing of Risk & Title (Consumer Rights Act 2015)

  • Passing of Risk: In accordance with section 29 of the Consumer Rights Act 2015, the goods remain at Frauntch Schull's risk until they come into the physical possession of you or a nominated carrier/person acting on your behalf (other than our standard courier).

  • Title: Title and ownership of the goods transfer to you only upon full receipt of payment and successful physical delivery.

6. Statutory Rights & Cancellations

Nothing in these Terms of Service affects, limits, or excludes your statutory rights under the Consumer Rights Act 2015 (including your right to receive goods that are of satisfactory quality, fit for purpose, and as described) or your right to cancel under the Consumer Contracts Regulations 2013 (the 14-day statutory cooling-off period).

7. Intellectual Property

All visual identity assets, bespoke tailoring photography, logos, monograms, editorial copy, trade dress, and website design elements associated with Frauntch Schull remain the exclusive intellectual property of Frauntch Schull and are protected by UK and international copyright, design right, and trademark laws. Unauthorised reproduction or commercial exploitation is strictly prohibited.

8. Limitation of Liability

Frauntch Schull shall not be liable for any indirect, consequential, or economic loss resulting from the use of our website or merchandise. Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of terms implied by section 17 of the Consumer Rights Act 2015 (title and quiet possession);

  • Defective products under the Consumer Protection Act 1987.

9. Governing Law & Jurisdiction

These Terms of Service and any non-contractual obligations arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute, claim, or controversy arising under or in connection with your purchase shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a resident of Scotland or Northern Ireland, you may also bring proceedings in your local respective courts.
